The dissolution of a marriage is never a pleasant event. It is disruptive for all involved, the spouses, the children and the extended family as well. The role of your lawyer is not to make things harder and more expensive, but to drain the experience of as much emotional energy as possible. This is important because a divorce is not only an emotionally taxing event, but it is also a tremendous financial event as well. When one considers the long-term economic effect of a divorce, the importance of good, solid advice becomes clear. Uncontested: this is the threshold question to all clients when they go to a lawyer for a divorce. Few divorces are truly uncontested when they begin, but most end well short of a courtroom battle. There are two factors that determine how difficult a divorce will be to settle: the degree of animosity generated by the events surrounding the separation, and the amount of assets to divide. “My neighbor was just divorced and they got…” Because divorces are uniquely personal to the people involved, no two are alike. You cannot compare your circumstances to anyone else. All the variables that make us individuals effect the final settlement of a divorce and therefore divorces simply cannot be compared. Who pays? The client is responsible for the fee. The law allows for the opposing party to be ordered to pay the attorney fees in whole or in part of the client. The request is always made, but not always ranted. The relative financial positions of the parties is more important than ‘bad acts.’ We will fight for your financial security at every opportunity. When children are involved… The lawyers and staff of O’Gorman & Sandroni fight for the interests of our clients. The court will appoint a lawyer to represent the interests of the children (called a guardian ad litem) if there are allegations of abuse or neglect, or if the parties dispute custody. Child Support: this is determined by using a complex formula. It calculates the income of the parents, the cost of caring for the children and certain other variables, to determine who receives support and how much they receive. This number is difficult to calculate and can only be estimated prior to full financial disclosure by both parties.
